In the US alone, hearings in congress, teamed with multiple lawsuits, made waves across the country, challenging users to think about their relationship with social media giants such as TikTok, Instagram, and Facebook.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the name of keeping children safe on social media, however, various US states and countries around the world are prepared to go much further, with the introduction of new laws affecting how children and teens use these apps. So, <\/span><b>what do new social media laws and restrictions mean for children?<\/b><span style=\"font-weight: 400;\"> And how can families help keep their loved ones safe as they scroll? \u00a0 <\/span><\/p>\n<ul><\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2><b>What do social media laws look like for children? <\/b><\/h2>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">The wave of bills across 2023 include a variety of suggestions and proposals, with some countries or states choosing to focus on how social media is set up at home, such as <\/span><b>age restrictions and parental permissions<\/b><span style=\"font-weight: 400;\">, while others are choosing to target the way that social media companies are set up for young people to use.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, Utah\u2019s Social Media Regulation Act:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Requires parental consent for under-18s to open a social media account<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sets a curfew between 10:30 pm and 6:30 am, not allowing under-18s to access social media during this period<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Allows parents and guardians to access their children\u2019s accounts, and posts on social media<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Requires companies to offer tools that allow parents and guardians to set time limits on children\u2019s social media use<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hides under-18s accounts from search results<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prohibits direct messages from those not on children\u2019s follower or friend list<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In contrast, California\u2019s legislation seeks to<\/span><b> take the social media companies themselves to task<\/b><span style=\"font-weight: 400;\">, hoping to reduce children\u2019s exposure to harmful content online. The bill prohibits a social media platform from \u201cadopting or implementing a practice relating to the targeting of content to minors that prioritizes user engagement over the safety, health, and well-being of minor users.\u201d<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2><b>What do these laws mean for children and teenagers? <\/b><\/h2>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">The implications of social media use on children\u2019s digital health and wellbeing are being studied more, and understood further as time goes by. As <\/span><a href=\"https:\/\/www.qustodio.com\/en\/from-alpha-to-z-raising-the-digital-generations\/social-media-qustodio-annual-data-report-2022\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">children spend increasing amounts of time on social media<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><b>there are concerns surrounding its effect on their mental health, attention span, and how addictive current social media platforms can be<\/b><span style=\"font-weight: 400;\">, especially for children\u2019s developing brains.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dangerous challenges also circulate on social media, and as peer pressure moves into the digital world, there is substantiated worry that children may feel the need to copy or emulate some of the risky, foolish behavior they are exposed to online. At least <\/span><a href=\"https:\/\/www.independent.co.uk\/tech\/tiktok-blackout-challenge-deaths-b2236669.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">20 deaths<\/span><\/a><span style=\"font-weight: 400;\"> have been linked to <\/span><a href=\"https:\/\/www.qustodio.com\/en\/blog\/talking-to-your-child-about-tiktok-challenges\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">dangerous TikTok challenges<\/span><\/a><span style=\"font-weight: 400;\"> since the beginning of 2022.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These issues have contributed in part to bill proposals across the US, and in other countries around the world. At the signing of the Utah bills, the state governor, Spencer J. Cox, referenced <\/span><a href=\"https:\/\/jamanetwork.com\/journals\/jamapsychiatry\/fullarticle\/2749480\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">studies<\/span><\/a><span style=\"font-weight: 400;\"> connecting heightened risk of mental health problems and extensive social media use. The representative hopes that <\/span><b>the bills will help reduce the risk of addiction, protect children as they explore social media, and hold social media platforms accountable<\/b><span style=\"font-weight: 400;\"> for harm caused, whether physical, psychological, or financial.<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2><b>What do social media restrictions look like outside the US?<\/b><\/h2>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">Countries and regions around the world are also making moves to restrict and limit the ways that children have access to social media &#8211; Europe in particular.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/bills.parliament.uk\/bills\/3137\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The UK\u2019s online safety bill<\/span><\/a><span style=\"font-weight: 400;\"> came into effect in late 2023, designed, among other things, to keep minors safe as they scroll, <strong>holding tech companies accountable for harmful content<\/strong> that young people could come across on their platforms.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">France, on the other hand, has already approved a bill that attempts to tackle issues with cyberbullying, social media addiction, and exposure to harmful content on social platforms. The bill, <\/span><a href=\"https:\/\/www.scottishlegal.com\/articles\/france-new-parental-consent-law-to-regulate-childrens-social-media-use\"><span style=\"font-weight: 400;\">which passed the French Senate in June 2023<\/span><\/a><span style=\"font-weight: 400;\">, <strong>requires parents to approve their child\u2019s access to social media if they are under 15<\/strong>. In addition, parents will be able to directly request that their child\u2019s social media account be suspended, and social media platforms will be required to provide tools that restrict how long children can spend on them.\u00a0<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2><b>What do the proposed laws mean for social media companies? <\/b><\/h2>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">These laws will require social media platforms to <\/span><b>carry out age verification for young users<\/b><span style=\"font-weight: 400;\"> in states and areas of the world where changes are proposed &#8211; though they don\u2019t lay out how companies will have to enforce this. Up until now social media companies have relied on children simply being honest about their age, which, as most parents know, is not the sturdiest barrier for intrigued teens and tweens setting up a new account online.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Social media <\/span><b>companies will also not be allowed to collect children\u2019s data, or show them targeted ads and sponsored content<\/b><span style=\"font-weight: 400;\">, which will require giants such as Instagram, TikTok, and Facebook to update their advertising mechanisms for minors. TikTok, for example, currently removes ads for their under-13 experience, but teenagers aged 13+ are exposed to advertising as they scroll. This will have to be updated under new laws.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Experts and digital rights advocates point out certain constitutional problems with the laws, such as the right to privacy, the right to access information, and the right to freedom of speech. Minors without an ID card would also be unable to access social media. Therefore, <strong>while restrictions and regulations are on the table, it doesn\u2019t necessarily mean they will be approved<\/strong>. In Arkansas, one of the US states to propose age verification and parental consent for minors on social media, a federal judge <\/span><a href=\"https:\/\/edition.cnn.com\/2023\/09\/01\/business\/arkansas-social-media-age-verification\/index.html\"><span style=\"font-weight: 400;\">blocked the proposed Social Media Safety Act<\/span><\/a><span style=\"font-weight: 400;\">, following a motion declaring the bill unconstitutional.\u00a0<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h2><b>How else can I keep my child safe on social media?\u00a0<\/b><\/h2>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p><span style=\"font-weight: 400;\">As the discussion surrounding safety for under-18s on social media heats up, many families are looking for ways to keep their children safe as they scroll and swipe, regardless of the state they live in, or the country.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whether enforced by law or not, <\/span><b>teens and tweens should be able to enjoy the positive side of the digital world<\/b><span style=\"font-weight: 400;\">. Despite the challenges social media platforms are facing, they won\u2019t be going anywhere fast. Families need to work together to create a safe online environment for their children, protecting them from harm while educating them on the potential dangers and <\/span><a href=\"https:\/\/www.qustodio.com\/en\/blog\/use-social-media-in-a-healthy-way\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">benefits of social media<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><b>Some steps families can take to keep their children safe as they use social media include:<\/b><\/p>\n<p><b><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Encouraging teens to follow a variety of accounts<\/b><span style=\"font-weight: 400;\">, that promote positivity and content which makes them feel good.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Teaching children how to be more mindful<\/b><span style=\"font-weight: 400;\"> of the time they spend on social media, and the type of content they\u2019re consuming. This can be as simple as pausing the scroll and taking a moment to reflect, or putting down the phone every once in a while to go do something else.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Establish device-free moments<\/b><span style=\"font-weight: 400;\">, where downtime is scheduled.
